The petitioner has filed the above Writ Petition to issue a Writ of Mandamus directing the respondent to consider the representation dated 20.12.2010 of the petitioner. 2.Mr.S.Rajendran learned counsel appearing for the petitioner submitted that the petitioner is seeking to cancel the patta issued in favour of the 2nd respondent in the representation dated 20.12.2010 given to the 1st respondent, the District Collector.

3. Admittedly, the petitioner's remedy is to file an appeal, however, the petitioner has not filed any appeal as contemplated under section12 of the Patta Passbook Act. In such view of the matter, I am not inclined to entertain the Writ Petition. However, it is open to the petitioner to file an appeal as per the provisions of section 12 of the Patta Passbook Act.

With these observations, the Writ Petition is dismissed. No costs.
