JUDGMENT

(Made by the Hon'ble Chief Justice) We have heard Mr.G.Pugazhenthi, learned counsel for the appellant; Mr.C.Kathiravan, learned Special Government Pleader, for respondents 1 to 3 and Mr.A.Anandan, learned Government Advocate, for the fourth respondent.

2. The appellant has filed a writ petition seeking direction to handover possession of the writ land to him. The appellant has also filed a suit in OS No.5 of 2022 before the District Munsif Court, Chidambaram. Learned Single Judge has observed that as the appellant has already filed a civil suit, he may file appropriate application for amendment of the relief and prosecute the said suit.

3. It is for the appellant to take appropriate steps in the

pending suit. The appellant cannot prosecute two proceedings in respect of the same property for the same purpose.

4. The writ appeal as such is disposed of. There shall be no order as to costs.
