SURESH KUMAR CRIMINAL MISCELLANEOUS PETITION No.10563 of 2017 IN CRL RC.1120/2017 C.SAMISELVAKIRUBAKARAN [ PETITIONER ] Vs S.JESSY, [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to stay the operation of the order dated 08.02.2017 made in M.C.No.5/2014 on the file of the Principal Family Court, Coimbatore which is a part of the common order made in D.O.P.No.1159/2013 & M.C.No.5/2014 on the file of the Principal Family Court, Coimbatore pending disposal of the above criminal revision petition.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.P.M.DURAISWAMY, Advocate for the petitioner and of M/S.V.S.USHA RANI, Advocate on behalf of the Respondents the court made the following order:- Ms.V.S.Usha Rani, learned counsel takes notice for the respondent.

2. There shall be an order of interim stay, on condition that the petitioner shall pay 50% of the arrears of maintenance as directed by the lower Court, which comes about Rs.65,000/-, as the total arrears would be a sum of Rs.1,35,000/- till August 2017. The said payment shall be made to the respondent, within a period of four weeks from the date of the receipt of a copy of this order and also the petitioner shall continue to pay a sum of Rs.2,000/- (Rupees Two Thousand only) per month as current maintenance to the respondent on or before 10th of every succeeding English calendar month without fail until further orders passed.
