ORDER

This Criminal Original Petition has been filed seeking to quash the First Information Report in Crime No.213 of 2025 on the file of the respondent. 2.

The case of the prosecution is that on 09.05.2025, the de facto complainant lodged a complaint alleging that the petitioners had encroached on a common pathway in Survey No.459/6 using a JCB and damaged a water pipeline. When it was questioned, the petitioners abused and assaulted the de facto complainant and her family members by using a knife. Based on the said complaint, the aforesaid case in Crime No.213 of 2025 has been registered by the first respondent for the offences punishable under Sections 296(b), 324(4), 118(1) and 351(3) of BNS r/w Section 3(1) of the TNPPDL Act. 3.

The learned counsel for the petitioners submitted that the petitioners are innocent and the de facto complainant's party are aggressors and they have only assaulted the petitioners resulting in the petitioners sustaining injuries. The first respondent, without conducting proper investigation, has registered the case against the petitioners.

The learned Government Advocate (Crl.Side) appearing for the first respondent submitted that the case has been registered recently on 19.05.2025. He further submitted that although a civil dispute is pending between the parties, the petitioners allegedly assaulted the de facto complainant with a knife, as a result of which, the de facto complainant sustained grievous injuries. He further contended that the case came to be registered only upon receipt of intimation from the hospital. He also submitted that the investigation has been completed and the final opinion is awaited. 5.

Heard the learned counsel appearing on either side and perused the materials available on record.

Though the petitioners contended that civil disputes are pending between the parties and that the de facto complainant's party are the aggressors, as per the prosecution, the de facto complainant has sustained grievous injuries. The case has been registered only on the basis of the intimation received the hospital. Ergo, at this stage, this Court is not inclined to delve into the merits of the case.

In view of the above facts and circumstances of the case and considering the nature of allegations and the stage of the investigation, this Court is of the considered opinion that no grounds are made out for exercising

the inherent powers of this Court under Section 482 of Cr.P.C., to quash the proceedings at this stage.
