ORDER

This Criminal Original Petition has been filed to order for an speedy disposal of C.C.No.1259 of 2019, on the file of the Fast Track Court-IV, Metropolitan Magistrate Court, George Town at Chennai.

2. The learned counsel for the petitioner submitted that, the case is pending for cross examination of PW1 from July 2022. The accused has not chosen to cross examine PW1 and the case is pending without any progress.

3. When this Court enquired the learned counsel for the petitioner, as to the number of cases pending before the learned Fast Track Court-IV, Metropolitan Magistrate Court, George Town at Chennai, he replied that, he is not aware of the details with regard to the pendency of the cases. Without having the information with regard to the pendency of the cases, on the file of Fast Track Court-IV, Metropolitan Magistrate Court, George Town at Chennai, this Court is not in a position to fix a time frame for the disposal of this case, for the reason 2/4

that several cases may be pending before the Court, which are filed in the year 2019 or prior to 2019.

However, the learned counsel for the petitioner restricted his prayer only for the completion of cross-examination of PW1, within a time frame, for the reason that, after PW1 was examined in chief on 07.07.2022, he was regularly appearing before the learned Magistrate, however the respondent has not crossexamined PW1.

5. In the light of the submission of the learned counsel for the petitioner, this Court directs the learned Magistrate, Fast Track Court-IV, Metropolitan Magistrate Court, George Town at Chennai to ensure that cross-examination of PW1 is completed within a period of one month from the date of receipt of a copy of this order.
