Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorari to call for the records on the file of the respondent in pertaining to order into Na.Ka.No.23/2013/A1 dated 14.03.2014 and quash the same and claiming infrastructure and basis amenities charges being a sum of Rs.4,89,950/- from the petitioner as illegal and arbitrary. O R D E R

The relief sought for in this Writ Petition is to quash the order passed by the respondent in proceeding dated 14.03.2014 directing the writ petitioner to pay the infrastructure and basic amenities charges as applicable.

2. The learned counsel appearing on behalf of the respondent/Municipality now produced the documents stating that the writ petitioner has not paid the infrastructure and basic amenities charges due towards the Municipality. Such charges were already paid by the other Housing Board owners. Therefore, the petitioner is also liable to pay.

3. The learned counsel for the petitioner, even during the hearing of the present writ petition stated that in the event of non-payment, the petitioner is liable to pay the infrastructure and basic amenities charges due to the Municipality. https://hcservices.ecourts.gov.in/hcservices/

4. Now the documents are produced by the learned counsel for the respondent that the petitioner has not paid the charges. Such being the factum of the case, the writ petitioner is liable to pay all the charges and accordingly, the order impugned is in accordance with the provisions of law, as there is no infirmity in it. Thus, the writ petition stands dismissed. No costs. Consequently, connected Miscellaneous Petition is closed.
