When the matter was listed for hearing on 02.11.2017, there was no representation on behalf of the appellant, hence, the matter was adjourned to 14.11.2017. On 14.11.2017 also, there was no representation for the appellant. Hence, the Registry was directed to list the matter on 17.11.2017 under the caption for dismissal. Today also, there is no representation on behalf of the appellant. In these circumstances, this court left with no other option except to dismiss the Civil Miscellaneous Appeal for non prosecution. Accordingly, the Civil Miscellaneous Appeal is dismissed for non prosecution No costs.
