..Respondent(s) Prayer: This petition has been filed under Article 226 of the Constitution of India, calling for the records of 1st respondent in Na.Ka.3632/2024/SaPa2 dated 12.11.2025 and ThaVa.4965/2025/Vi.A dated 05.01.2026 namely, Show Cause Notice issued under Sec.87 of Tamil Nadu Cooperative Societies Act, 1983 and the consequential Notice for Attachment Before Judgment under Section 167(1) of the Tamil Nadu Cooperative Societies Act, 1983 respectively and quash the same as illegal, without jurisdiction and non est in the eye of law for nonfurnishing of Sec.81 Enquiry Report and the documents relied therein, Sec.82 Inspection Report dated 11.12.2023 and Modified Sec.82 Inspection Report

dated 24.06.2024 based on which 1st respondent's impugned Show Cause Notice dated 12.11.2025 said to have been issued and for the non-compliance of mandate of Sec.167(1) of the Tamil Nadu Cooperative Societies Act, 1983. For Petitioner(s):

The grievance of the petitioner is that without furnishing the documents the petitioner seeks, the respondents are proceeding with the 87 surcharge proceeding.

2. When the writ petition came up for admission, Mr.L.S.M.Hasan Fizal representing Ms.E.Ranganayaki has produced instructions received from the Deputy Registrar of Co-operative Societies, the first respondent herein, that only after furnishing of the documents, 87 surcharge proceeding will be proceeded further. The instructions given to Ms.E.Ranganayaki are scanned and extracted hereunder:-

3. As the first respondent herself has stated that whatever the documents the petitioner seeks, which of course are connected with 87 surcharge proceedings the question of passing further orders in the writ petition does not arise.

4. Recording the instructions given by the learned Additional Government Pleader, this writ petition is disposed. Consequently, connected miscellaneous petition is closed No costs.
