Writ Petition is filed under Article 226 of the Constitution of India to issue a writ of mandamus to direct the respondent to consider the claim of the petitioner for appointment on Compassionate grounds in any suitable post commensurate with his educational qualifications consequent on the death of his father Thiru. P.Kondalrao on 22.11.2017 while serving as Sanitary Worker in Pachaiappa's College Higher Secondary School, Chennai - 600 001, a Government aided recognised Private School, in the light of the application dated 09.04.2018.

ORDER

Heard Ms.Akshaya Shankar, the learned Counsel for the petitioner, Mr.P.Gurunathan, the learned Additional Government Pleader for R1 to R3 and Mr.B.Vijay, the learned Counsel for R4.

2. The petitioner has filed this writ petition seeking a writ of mandamus to direct the respondents to consider the claim of the petitioner for appointment on Compassionate grounds in any suitable post.

3. The petitioner's father was working as a Sanitary Worker in Pachaiyappa's College Higher Secondary School, Chennai and he died on 22.11.2017 while he was in service. The petitioner has given an application to the respondents as early as on 09.04.2018, to consider him for appointment on compassionate scheme but so far the said application was not considered.

4. Ms.Akshaya Shankar, the learned counsel for the petitioner, submitted that the petitioner and his mother have no other source of income except the family pension of his father.

5. Considering the circumstances of the case, the respondents are directed to consider the petitioner's application dated 09.04.2018 and pass orders in accordance with law and on its own merits, within a period of

four weeks from the date of receipt of a copy of this order.

6. With the above direction, this Writ Petition is allowed. No costs. 06.03.2024 Index: Yes / No Speaking order / Non-speaking order bkn
