Respondent(s) PRAYER; This writ petition has been filed under Article 226 of Constitution of India, to issue a writ of Mandamus, directing the 3rd respondent to issue a No Objection certificate (NOC ) to the petitioner for the property situated at Survey No. 452 bearing address Flat No. S2, IInd Floor, 2 and 3 South Mada Street, Nungambakkam , Chennai 34 and Flat No. S3, IInd Floor, 2 and 3, South mada street, Nungambakkam, Chennai 34 and consequently direct the 1st respondent to receive and register any document for the said property. ORDER

The writ petition has been filed seeking a direction to the 3rd respondent to issue a No Objection certificate (NOC) to the petitioner for the property situated at Survey No. 452 bearing address Flat No. S2, IInd Floor, 2 and 3 South Mada Street, Nungambakkam , Chennai 34 and Flat No. S3, IInd Floor, 2 and 3, South Mada street, Nungambakkam, Chennai 34 and consequently direct the 1st respondent to receive and register any document for the said property.

It is the case of the petitioner that he claims that he is the owner of the property in S.No.452 situated at South Mada Street, Nungambakkam Chennai 34 and he purchased the property from the land owner. Thereafter, the petitioner made a representation 17.08.2022 for issuance of NOC from the HR & CE Department and the same is not considered. Hence, the present writ petition.

3. The learned Government Advocate appearing for the respondent submitted that the property in S.No.452/45 and 452/48 is belonging to Agastheeswarar Prasanna Venkatesa Perumal Temple. The petitioner purchased a property from one Kanniammal who is the hereditary trustee. The very same alienation made by the said Kanniammal, the petitioner already filed a writ petition before this Court and the same was dismissed. As against, writ appeal has been filed and the same was also dismissed. For the very same property, the

petitioner has filed a writ petition before this Court, which is not sustainable.

4. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the respondents and perused the materials available on record.

5. The petitioner has filed the present writ petition for issuance of NOC and the same was rejected vide order dated 03.02.2023. Without challenging the said order, filing the present writ petition for mandamus is not sustainable and the same is liable to the dismissed.

6. Accordingly, the writ petition is dismissed. No costs.
