PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, to set aside the order dated 25/10/2016 in Crl.M.P.No.4021/2016 in C.C.No.406 of 2015 dismissing the 311 Cr.P.C. passed by the learned Fast track Court Magistrate IV at George Town, Chennai and allow the same.

O R D E R

This Criminal Original Petition has been filed to set aside the order dated 25/10/2016 in Crl.M.P.No.4021/2016 in C.C.No.406 of 2015 dismissing the 311 Cr.P.C. passed by the learned Fast track Court Magistrate IV at George Town, Chennai and allow the same.

It is seen that the petitioner/accused filed petition under Section 311 of Cr.P.C before the learned Metropolitan Magistrate, Fast Track Court-IV, George Town Chennai-1, in Crl.M.P.No.4021 of 2016 in C.C.No.406 of 2015, to recall the P.W-1. On 25.10.2016, the learned Magistrate dismissed the petition on the ground that there is no such reasons adduced in the petition and the petition was filed after the case is posted for DWs.

In view of the facts and circumstance of this case, this Court does not find any reason to interfere in the order in Crl.M.P.No.4021 of 2016 in C.C.No.406 of 2015, passed by the learned Metropolitan Magistrate, Fast Track Court-IV, George Town, Chennai-1.

Accordingly the Criminal Original Petition is dismissed. The trial Court is directed to complete the trial within a period of three weeks from the date of receipt of copy of this order. Consequently, connected miscellaneous petition is closed.
