Learned counsel for the petitioner/appellant would submit that the accused had admitted the issuance of the cheque. The trial court on erroneous finding of fact and law regarding statutory presumption had acquitted the respondent/accused. Though the accused has stated that the cheque was in fact handed over to one Vivekanandan, no evidence was let in on the defence to prove the same. Leave is granted.
