This writ petition has been filed for issue of writ of mandamus directing the 3rd respondent to deal with the representation made by the petitioner on 19.08.2024, wherein, the petitioner is seeking for the change of name in the patta with respect to the subject property.
2.Heard Mr.R.Dillikumar, learned counsel appearing on behalf of the petitioner and Mr.S.Jayachandran, learned Government Advocate appearing on behalf of respondents 1 to 4.
3.The case of the petitioner is that the property originally belonged to his mother. She died intestate and it devolved upon the legal heirs. By virtue of the Release Dated 11.09.2023, the father and sister of the petitioner released their share in the property in favour of the petitioner. Thus, the petitioner is in possession and enjoyment of the property and he is claiming right and title over the property. 4.The further case of the petitioner is that Patta No.722 has been wrongly 2/4
issued in the name of one Manonmani who is the adjacent land owner. According to the petitioner, she was the owner of the land in S.No.154/A1. Later she settled the property in favour of her son Senthilkumar. However, the patta continues to stand in the name of Manonmani. The petitioner submitted the representation before the 3rd and 4th respondents in this regard. An enquiry was conducted by the 4th respondent and the matter was pending before the 3rd respondent without any further progress. It is under these circumstances, the present writ petition came to be filed before this Court.
5.Taking into consideration the facts and circumstances of the case and considering the limited relief sought for in this writ petition, there shall be a direction to the 3rd respondent to deal with the representation dated 19.08.2024 made by the petitioner and appropriate orders shall be passed on its own merits and in accordance with law after affording opportunity to the above said Senthilkumar whose mother's name is found in the patta and order shall be passed, within a period of six weeks from the date of receipt of copy of this order. 3/4
