ORDER
The present writ petition is filed challenging the proceedings of the 2nd respondent dated 18.11.2022, quash the same and consequently forbear the 3rd respondent, their men, agents, servants, subordinates or anyone acting under him from in any manner interfering with the peaceful possession and enjoyment of the properties comprised in S.Nos.306/2A and 306/2B, situated at No.32, I, Basin Road, Sathankadu Village, Thiruvotriyur, Chennai-600 019.
2. At the outset, learned Additional Solicitor General appearing for the respondents pointed out that petitioner may have to submit their reply to the impugned notice. He would further submit that if any such reply is submitted by petitioner, the same would be considered by the respondents and appropriate orders would be passed in accordance with law, more particularly, keeping in view Sections 4 and 5 of Public Premises (Eviction of Unauthorised Occupants) Act, 1971. Agreed to by the learned counsel for petitioner.
3. In view thereof, the writ petition stands disposed of, the petitioner may
submit their reply to the impugned notice. If any such reply is submitted by the petitioner, the same shall be considered by the respondents and appropriate orders shall be passed on merits and in accordance with law, keeping in view Sections 4 and 5 of Public Premises (Eviction of Unauthorised Occupants) Act, 1971. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the case on its own merits and in accordance with law.
