No.49 of 2017.

2. The petitioner / appellant is the plaintiff who filed a suit for partition and other consequential reliefs. By the judgment and decree of the lower appellate Court, the decree of the trial Court granting limited share in favour of plaintiff is reversed.

Therefore, there is nothing to stay the operation of judgment and decree of the lower appellate Court.

3.Hence, the civil miscellaneous petition is dismissed. It is open to the petitioner to seek appropriate prayer, if he is advised so.
