This case came up for settlement before the Lok Adalat. Both the parties are present. Mr.E.Rajadurai for M/s.M.B.Gopalan Associates, learned counsel for appellant and Mr.K.Balaji, learned counsel for the respondents 1 and 2 are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:
TERMS OF SETTLEMENT The respondents 1 and 2 herein filed M.C.O.P.No.3262 of 2017 before the claims Tribunal, Chennai, claiming compensation amount of Rs.50 lakhs. The Tribunal awarded a sum of Rs.16,22,000/- with interest and cost. Aggrieved by the above award amount passed by the Tribunal, the Insurance company preferred the present appeal. 2.Both the parties having initiated negotiation successfully arrived at a settlement of all the issues arisen in this case as follows: 3.The appellant-M/s.Liberty General Insurance Ltd. has agreed to pay a sum of Rs.23,00,000/- (Rupees Twenty Three lakhs only) in full quit. The respondents 1 and 2 have agreed to receive the said amount of Rs.23,00,000/- (Rupees Twenty Three lakhs only) in full quit within a period of four weeks after the award is passed by the National Lok Adalat.
4.Both the parties made a formal request to the National Lok Adalat to pass award in terms of the above settlement. 2/5
5.As a result, award is passed hereby in terms of the above compromise arrived at between the parties directing the appellant herein to pay a sum of Rs.23,00,000/- (Rupees Twenty Three lakhs only), less the sum of Rs.25,000/- already deposited, in full quit within a period of four weeks from the date of receipt of a copy of order passed by the National Lok Adalat.

The respondents 1 and 2 are permitted to receive the equal share of the amount of Rs.23,00,000/- agreed to be paid by the appellant. 7.Consequently, the Civil Miscellaneous Appeal stands disposed of. The Court Fee paid by the appellant to be refunded. Consequently, the connected civil miscellaneous petition is closed.
