PRAYER : Petition filed under Article 226 of the Constitution of India, praying to issue Writ of Certiorarified Mandamus to call for the records in E-Service Application No.TN-720180721614 dated 27.07.2018 of the respondent and quash the same and consequently, direct the respondent to issue legal heirship certificate to the petitioner.

The petitioner has come up with this writ petition to issue a Writ of Certiorarified Mandamus to call for the records in EService Application No.TN-720180721614 dated 27.07.2018 of the respondent and quash the same and consequently, direct the respondent to issue legal heirship certificate to the petitioner.

2. The case of the petitioner is that on the basis of the Circular No.11/2017, Rc.No.RA.5(3)/180/2017, issued on 09.08.2017 by the Commissioner of Revenue Administration, the petitioner's application for legal heir certificate came to be rejected. Challenging the same, the petitioner is before this Court.

3. When the matter is taken up for consideration, it is brought to the notice of this Court that the said Circular had already been issued on 09.08.2017, giving certain directions to the authorities for the procedure to be followed and Mr. J.Ramesh, learned Additional Government Pleader appearing for the respondent, fairly submitted that the petitioner's application for legal heir ship certificate to the respondent dated 21.07.2018, would be considered in the light of the above Circular, within a period of eight weeks.

Recording the submission made on behalf of the learned Additional Government Pleader appearing for the respondent, the respondent is directed to consider the application of the petitioner dated 21.07.2018 and pass appropriate order on merits and in accordance with law after affording due opportunity of personal hearing to the petitioner as well as any of the interested parties. Such exercise shall be completed within a period of eight weeks from the date of receipt of a copy of this order.
