The petitioners, who apprehend arrest for the alleged offence under Section 174 (iii) Cr.P.C. Altered to 498 (A), 304(B) of I.P.C. in Cr.No.164 of 2022 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that on 13.12.2019 the defacto complainant's sister namely Meena aged about 28 years got love marriage with the petitioners' son namely Hariharan. After their marriage both of them, were living in a separate house in the Ishwarya Apartment,Parthasarathy Nagar, Siruniyam and one male child was born. On 14.03.2022, at about 10.00 p.m, the defacto complainant received a message that his sister was committed suicide by hanging. The petitioners and their son demanded dowry from the deceased Meena due to which she committed suicide. Hence, the complaint.

3.The learned counsel appearing for the petitioner would submit that the petitioners never demanded dowry from the deceased and they are living separately and the deceased lead a peaceful matrimonial life in a separate house. He further submit that the petitioners came to know that during the birthday celebration of their son due to some petty quarrel, between from husband and wife, the wife had committed suicide and the petitioners have not committed any offence as alleged by the prosecution Hence, the learned counsel prays to grant anticipatory bail to the petitioners. 4.The learned Government Advocate (Crl.side) would submit that The RDO report says this is a case of dowry harassment, and there is no over tact. Therefore, he vehemently opposed to grant bail to the petitioners.

5. Considering the facts and circumstances of the case and the submissions made by both counsel and also considering the fact that the RDO report says that this is a dowry harassment, both the deceased and A1

got married recently in the year 2022 and also on considering the fact that there is possibility of tampering with the witnesses and hampering the investigation, this Court is not inclined to grant bail to the petitioners. Accordingly, this Criminal Original Petition is dismissed. 31.01.2023 vsn
