The petitioner seeks a direction to the learned Judicial Magistrate No.1, (Special Judge for Juvenile Justice Board), Namakkal to consider his bail application on the same day in connection with Crime No.50 of 2015 on the file of the respondent police.

2. Under section 12 of the Juvenile Justice Care and Protection Act, grant of bail is mandatory, even if the offence is bailable or non bailable. The circumstances under which the bail can be refused are safety and security of the victim/petitioner. 3.The submissions made by Mr.C.S.Saravanan, learned counsel for the petitioner and by Mr.P.Govindarajan, learned Additional Public Prosecutor representing the respondent were heard. The materials available on record were also perused.

4.Considering the stated circumstances, the learned Judicial Magistrate No.1, (Special Judge for Juvenile Justice Board), Namakkal is directed to consider the bail application of the petitioner/Juvenile on merits and pass appropriate order on the same day of his appearance.
