ORDER
The petitioner, who was arrested and remanded to judicial custody on 21.12.2025 for the offences punishable under Section 64(1) of BNS, 2023 in Crime No.17 of 2025, registered on the file of the respondent police, seeks bail. 1/4
2. The allegation against the petitioner is that he is a doctor, under whom the defacto complainant was working as a part-time employee. It is alleged that the defacto complainant was a student of Physiotherapy and on the date of occurrence, the petitioner called her to assist him in providing treatment to a lady patient. Accordingly, she went their, and after completing massage and other treatment, while returning, the petitioner offered her an intoxicating drink, and taken up to her isolated flat and committed rape on her. During the intercourse, she gained consciousness and she immediately objected and came out of the flat. It is further alleged that the petitioner dropped her in front of another house, from where she immediately contacted her family members. She also questioned the act of the petitioner with his wife and thereafter, she lodged a complaint against the petitioner. Hence, a case has been registered and the petitioner was arrested.

The learned counsel appearing for the petitioner submitted that there was no such occurrence had taken place and taking advantage of isolation and intimacy, the defacto complainant has demanded money through the petitioner's wife. Immediately, the petitioner also called the police for her safety, and thereafter the defacto complainant left there and lodged a false complaint, stating that he is ready to cooperate with the investigation. Hence, he prays to grant bail to the petitioner.

4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that it is the case of rape. He further submitted that the victim was medically examined, necessary samples were collected and the same have been sent for chemical analysis and that the investigation is still pending. However, he opposed to grant bail to the petitioner.
5. Heard both sides and perused the materials available on record including the First Information Report.
6. On perusal of FIR, the statement of the victim and other connected materials, it was revealed that there are various disturbing facts. More particularly, the victim has categorically stated that the petitioner committed sexual intercourse with her after administering an intoxicating drink. Considering the gravity of the offence and the fact that the investigation is still pending, this Court is not inclined to grant bail to the petitioner.
