ORDER

The petitioner asserts that he is the owner of 3,600 sq.ft of land in Survey No.116, Karaikal Village. According to the petitioner, the Release Deed dated 26.05.2010 was executed fraudulently by the respondents 5 to 7, releasing their shares to the 8th respondent. After submitting representation dated 28.04.2025 seeking deletion of the entry related thereto from the records of the Registration Department, the present writ petition has been filed.

2. Learned counsel for the petitioner submits that the petitioner would be satisfied with consideration of the representation seeking removal of the entry.

3. Mr.V.Vasanthakumar, learned Additional Government Pleader, appears on behalf of the respondents 1 to 4. On the basis of written instructions, he submits that the writ petition has been filed under the misconception that the Registering Officer has the power to cancel a registered document. He also points out that the appropriate remedy for the petitioner is to approach the jurisdictional civil court.

4. The petitioner has approached this Court in January 2026, seeking cancellation of Release Deed dated 26.05.2010. The allegation is that such Release Deed was executed fraudulently. Evidently, consideration of the petitioner's grievance entails examination of disputed questions of fact. The petitioner has approached this Court without providing any explanation for the inordinate delay. The appropriate remedy for the petitioner is to approach the jurisdictional civil court.

5. Therefore, this writ petition is disposed of by leaving it open to the petitioner to approach the jurisdictional civil court in accordance with law. No costs. Consequently, connected miscellaneous petition is closed. 19-02-2026 (1/2) Index: Yes/No Speaking/Non-speaking order kak
