Writ Petitions filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus directing the respondents to apply a formula which ensures equal and fair distribution of wheat under the OMSS(D) release in the Tamil Nadu and Pondicherry Region from January 2006 onwards among the millers in Tamil Nadu and Pondicherry or in the alternate apply the same method as that was carried on in earlier years upto December 2005 and release such wheat expeditiously. For Petitioners (in all W.Ps') :Mr.Nithyanendhan for Mr.N.Umapathi For Respondents :Mr.M.Karthikeyan (in all W.Ps') Standing counsel C O M M O N O R D E R The prayer sought for in these Writ Petitions is for a Writ of Mandamus directing the respondents to apply a formula which ensures equal and fair distribution of wheat under the OMSS(D) release in the Tamil Nadu and Pondicherry Region from January 2006 onwards among the millers in Tamil Nadu and Pondicherry.

2. Though such a prayer has been sought for some time in 2006, thereafter much water has been flown under the bridge, therefore, the learned counsel appearing for the petitioners as well as the learned Standing counsel appearing for the respondents / Food Corporation of India on instructions, would submit that, in the present context, the prayer sought for in these Writ Petitions would have no effect and virtually, those petitions have become infructuous.

3. Recording the said submission made by the learned counsel appearing for both sides, all these Writ Petitions, since have become infructuous, are dismissed. However there shall be no order as to costs.
