This petition has been filed to condone the delay of 325 days in filing the petition to set aside the order dated 25.11.2009 passed against the 2nd respondent in the above writ petition.

2. Heard the learned counsel for the petitioner.

3. It is seen from the records that since the petitioner did not pay batta, this Court, by order dated 25.11.2009, directed the petitioner to pay batta on or before 09.12.2009, failing which, the petition will be dismissed automatically. Even thereafter, the petitioner did not pay batta. Therefore, the petition was dismissed. Again, the petitioner has filed the above M.P.No.1 of 2010 to condone the delay of 325 days to restore the petition. Though notice was ordered in this condonation petition on 15.12.2010, no steps have been taken by the petitioner. This shows the lethargic attitude of the petitioner in prosecuting the case. Therefore, this Court is not inclined to entertain this petition. Accordingly, the petition is dismissed.
