Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus after calling for the records from the first respondent relating to the order dated 10.03.2003 in CP.No.210 of 1999, quash the same insofar it denies the benefits claimed by the petitioner and consequently direct the second respondent to pay the balance amount of Rs.2,51,484.30/- as claimed by the petitioner. Prayer in W.P.No.34644 of 2003:

Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus after calling for the concerned records from the first respondent relating to the award dated 10.03.2003 in ID.No.439 of 2000 and quash the same as being illegal, unjust and arbitrary and issue a consequential Mandamus directing the second respondent to reinstate the petitioner with backwages, and all other attendant benefits after adjusting Rs.25,000/- paid to the petitioner. COMMON ORDER With the consent of both the parties, both these writ petitions are taken up for final disposal.

Mr.Govardhanan, learned counsel appearing for the petitioner would submit that inspite of their best efforts, they were unable to contact the petitioner for the purpose of obtaining instructions, as to whether they can proceed with the case or not. In this background, the learned counsel would report no instructions, but would also seek for liberty to revive the writ petition, in case he has any subsequent instructions from his client.

3. Recording the submission of the learned counsel for the petitioner, this writ petition stands dismissed with liberty to the petitioner to file an application to reopen this writ petition. No costs. Consequently, connected miscellaneous petition is closed.
