PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of Certiorari calling for the records relating to the proceedings of the fourth respondent Circular No.DGM(RP)/P&A/021/99, dated 12.08.1999, quash the same.

O R D E R
When the Circular impugned in the present writ petition came to be challenged by another employee before this Court in W.P.No.20352 of 2001 dated 12.12.2009, this Court in the said order has sustained the impugned Circular and had directed the employee therein to submit his objections to the enquiry. In view of the earlier orders of this Court, the Circular impugned in the present writ petition cannot be interfered with. Nevertheless, if the petitioner is aggrieved against the Enquiry Officer's Report, it is always open to him to raise his objection to the Show Cause Notice issued, pursuant to the enquiry report.
2. In the light of the above observations, the writ petition stands closed, with liberty to the petitioner to make sufficient objections to the enquiry report, if he is so advised. No costs. Consequently, connected miscellaneous petition is closed.
