ORDER
The petitioner who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 296(b), 115(2), 351(3) and 326(g) of BNS, 2023 and Sec.9(B)(1)(a), 9(B)(1)(b) of Explosives Act, in Crime No.384 of 2024 on the file of the respondent police, seek anticipatory bail.
2. The case of the prosecution is that the petitioner along with other accused alleged to have assaulted the de-facto complainant's brother with dangerous weapons and that
they used a country bomb and the bomb exploded in the back side of the de-facto complainant's house. Hence the complaint.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that the petitioner was arrayed as an accused only based on the confession statement of the coaccused. He further submitted that the petitioner is ready and willing to furnish substantial sureties and to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioner. 4.Learned Government Advocate (Crl.Side) appearing for the respondent police while opposing for grant of anticipatory bail submitted that there is one previous case of similar nature is pending against him and there is no change in circumstances. 5.Heard the learned Counsel for the petitioner and the learned Government Advocate (crl.side) and perused the materials available on record. 6.Taking into consideration the nature and gravity of the offence committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
7.Accordingly, this Criminal Original Petition is dismissed.
