PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, forbearing the respondents from deducting the pension amount payable to the petitioner under the Post Retirement & Death in Service Benefit Scheme of Rs.1931 from the ex-gratia amount of Rs.5600 payable under Agrani Samman Scheme which has come to an end in 2006 as per Clause 4(d) in the letter in Ref in 11/23/9dEP dated 20.09.1991 issued by the 2nd respondent and further direct the respondents to reimburse a sum of Rs.44,413/- along with interest deducted towards Post Retirement & Death in Service Benefit Scheme from 01.07.2006 from the Agrani Samman Scheme.

Today, when the matter was called, the learned counsel for the petitioner submitted that the petitioner had expired on 03.08.2013 and she is unable to contact the legal heirs of the petitioner.
2. Since no application has been filed for substituting the legal heirs of the petitioner, the Writ Petition stands dismissed as abated. In case the legal heirs of the petitioner are of the view that the cause of action still survives, liberty is hereby granted to them to file an application to restore the writ petition, within a period of 3 months from today. No costs. Consequently, connected miscellaneous petition is closed.
