Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus calling for the records relating to order dated 21.08.2014 in No.P.A.12/PA.P/572 TNSTC/Dharmapuri/2014 of the 2nd respondent, quash the same and consequently direct the respondents to provide the petitioner forthwith appointment on compassionate ground. 1/4

ORDER

The petitioner's husband passed away in an accident on 13.07.2008. He was working as a Conductor and due to the rash and negligent driving of the offending vehicle belonging to the Karnataka State Transport Corporation, his life has been snuffed off. 2.The case of the petitioner is that as her husband had died during the course of service, so she is entitled to appointment on compassionate basis as well as for payment of compensation. 3.The TNSTC considered the plea for payment of compensation and paid a sum of Rs.1,50,000/-, but rejected the case for compassionate appointment. The rejection was on the ground that the 2/4

petitioner's husband was not a permanent employee. Challenging the same, the present Writ Petition has been filed. 4.Heard Ms.V.Porkodi, learned counsel for the petitioner and Mr.Babu Raj representing Mr.R. Babu, learned counsel for the 2nd respondent.

5.Here is a case where the petitioner's husband was not even made a permanent employee. He was under probation. There is no scheme to grant compassionate appointment in case of death of such kind of persons. In the absence of such a scheme, I am not in a position to grant the relief to the writ petitioner.
