PRAYER: Criminal Original Petition is filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023/Section 482 of Cr.P.C, to direct the Respondent 1 and 2 herein to give police protection to the life and limb of the petitioners by considering the representation dated 10.09.2024. For Petitioners : M/s D.Kamatchi For R1 and R2 : Mr.R.Vinothraja Government Advocate (Crl.side)

ORDER

This Criminal Original Petition has been filed for direction directing the Respondent 1 and 2 herein to give police protection to the life and limb of the petitioners by considering the representation dated 10.09.2024.

2. Heard the learned counsel for the petitioners and the learned Government Advocate (Crl.side) for the respondents 1 and 2 and perused the materials placed on record.

3. The petitioners are in custody of cash to the tune of more than Rs.40 Lakhs. The third respondent is the second wife of the first petitioner. According to the first petitioner, though he had provided all facilities and seedhana articles during the marriage of his children, now they have an eye on the cash possessed by the first petitioner.

4. The respondents 3 to 11 engaged in illegal activities and also attacked the first petitioner, causing him to sustained injury. So far, two cases have been registered as against the respondents 3 to 11, one in Crime No.4 of 2023 for the offences punishable under Sections 147, 294(b), 323, 324 and 506(1) of IPC and another in Crime No.76 of 2022 for the offences punishable under Sections 294(b) and 323 of IPC and Section 4 of TN Prohibition of Harassment of Women Act, 2002.

5. After completion of investigation in Crime No.4 of 2023, the final report has been filed and the same has been taken cognizance in C.C.No.44 of 2023, on the file of the learned Judicial Magistrate, Ariyalur and it is pending for trial. Even thereafter, the respondents 3 to 11 attempted to attack the petitioner, since the petitioner is in possession of a sum of Rs.40 Lakhs. Though the petitioner lodged a complaint, the second respondent did not take any action as against the respondents 3 to 11 herein.

6. In view of the above, the second respondent is directed to conduct detailed enquiry on the subsequent complaint lodged by the petitioner as against the respondents 3 to 11 herein and take appropriate action against them in the

manner known to law.

7. With the above directions, this Criminal Original Petition stands disposed of.
