Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus, directing the respondent Nos.5, 6 and 7., to consider the petitioners representation dated 17.08.2023 duly addressed to all the respondents herein, expeditiously and thus ensure the removal of the encroachments made in the 6 feet wide passage connecting the Lake View Road / Erikkarai Street at Jafferkhanpet, Chennai- 600 083, and the land and building at No.1, Kambar Street, 285 Bharathi Block, Jafferkhanpet, Chennai- 600 083, as well as the rejection of application seeking drainage connection and metro water connection through the said 6 feet passage to the respective residences of respondent No.8 and 9.

ORDER
(Made by the Hon'ble Chief Justice) Heard Mr.M.K.Sathish, learned counsel for the petitioner, Mr.A.Edwin Prabakar, learned State Government Pleader assisted by Mr.T.K.Saravanan, learned Government Advocate for respondents 1 and 5 and Mr.A.Arun Babu, learned counsel for respondents 2 and 6.
2. Learned counsel for the petitioner submits that the passage has been encroached by respondents 8 and 9.
3. There are no documents to substantiate the said contention in the present writ petition.
4. The petitioner has already given a representation to the second respondent. The second respondent may decide the said representation on its own merits and in accordance with law after adhering to the principles of natural justice, preferably within a period of three months.
5. The writ petition, accordingly, stands disposed of. There shall be no order as to costs. Consequently, W.M.P.Nos.3085 and 3086 of 2024 are closed.
