Common Prayer: Civil Miscellaneous Appeals filed under Section 19 of the Family Courts Act r/w. Order XLI, Rule 1 of C.P.C., against the order and decree dated 14.11.2022 made in HMOP.Nos.3615 & 3860 of 2012 on the file of the VI-Additional Principal Family Court, Chennai. For Appellant : Mr.R.Marudhachalamurthy in both appeals For Respondent : Ms.C.S.Vedavalli in both appeals C O M M O N J U D G M E N T (Judgment of the Court was made by R.SUBRAMANIAN, J.) The parties are present. A memorandum of compromise has signed by them and their respective counsel has been filed. The parties have 1/4
agreed to have the marriage dissolved and the appellant / husband has also paid a sum of Rs.1,00,00,000/- (Rupees One Crore only) by way of demand draft as found in Claue - 4(b) of the compromise. There is also an agreement to pay a sum of Rs.50,00,000/- (Rupees Fifty Lakhs only) to the son after completion of his graduation.
2.In view of the said compromise, the appeal in C.M.A.No.417 of 2023 is allowed and a decree for divorce is granted. The appeal in C.M.A.No.418 of 2023 is also allowed and the O.P.No.3860 of 2012 filed under Section 9 of the Hindu Marriage Act for restitution of conjugal rights will stand dismissed. The memorandum of compromise will form part of the decree. No costs.
