PRAYER: Civil Miscellaneous Second Appeal filed under Section 43 Rule 1 r/w Section 9 of CPC r/w Section 100 of CPC, to set aside the judgment and decree dated 18.3.2015 passed in C.M.A.No.15 of 2014 on the file of the Principal District Judge, Namakkal confirming the judgment and decree dated 03.04.2014 passed in I.A.No.131 of 2012 in H.M.O.P.No.224 of 2012 on the file of the Subordinate Judge, Namakkal.

JUDGMENT

The learned counsel appearing for the appellant would submit that H.M.O.P.No.224 of 2012 has been disposed of by the Subordinate Judge, Namakkal on 17.3.2016 and hence, the second appeal arising against the interim order claiming the interim maintenance has become infructuous and he has also made an endorsement to that effect.

2. In the light of the above submission and the endorsement made by the learned counsel for the appellant, this Civil Miscellaneous Second Appeal is dismissed as having become infructuous. No costs. Consequently, connected miscellaneous petition is closed.
