Respondents Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Certiorarified Mandamus, calling for the records relating to first respondent's impugned order made in Lr.No.EE/Q&M/AS/AE/CAUP/F.TOE/D.No.6391 dated 25.09.2007, to quash the same and consequently direct the respondents to refund the sum of Rs.4,69,812/- with accrued interest to the petitioner. O R D E R

The matter is with regard to levy of penalty and compensation charges by the respondent Electricity Board for certain illegalities committed by the petitioner in the electricity meter in respect of the Electricity Service Connection in his hotel at No.303 (Old No.146), Thambu Chetty Street, Chennai-600001. This writ petition has been filed to set aside the impugned order passed by the first respondent and for a direction to refund a sum of Rs.4,69,812/- with accrued interest, being the payment made by the petitioner against the levy. 2.This writ petition was filed in the year 2007 and the same was admitted on 29.11.2011, and till now the matter is kept pending. No interim order has been passed by this Court, right from the date of filing the writ petition.

In the above circumstances, there is no purpose in keeping this writ petition pending. 3.Considering the facts and circumstances of the case, the petitioner is directed to submit a detailed representation in this regard to the respondents within a period of two weeks from the date of receipt of a copy of this order. On such representation being made, the respondents shall consider the same and pass appropriate orders on merits and in accordance with the law, as expeditiously as possible, preferably within six weeks.
