Respondents Petition filed under Article 226 of the Constitution of India praying for issue of Writ of Declaration declaring Clause 2(c) of the Special Rules issued in G.O.Ms.No.1692 Public Works Department dated 4.10.85 as null and void and unconstitutional and consequently direct the respondents 1 to 3 not to promote the respondents 4 to 8 to the post of Assistant Executive Engineer (Electrical) in the panel for the year 2005-2006, under the category of Junior Engineer (Electrical) or in alternate direct the respondents not to implement the ratio of 3:1 in the absence of the rider clause protecting the seniority of Assistant Engineers possessing degree in Engineering and having more length of service than the Diploma holders.
