ORDER

The petitioner has filed the present petition to direct the respondents to comply with the order dated 10.09.2024 in Crl.M.P.No.6552 of 2024, Judicial Magistrate No.1, Pollachi, to enquire upon the complaint and to take necessary steps to direct the respondents to register an FIR and to take legal action against the accused.

2. Learned Government Advocate (Criminal Side) appearing for the respondents submitted that, already, the FIR was filed and registered in Crime No.14 of 2023. Pending investigation, though the petitioner has also given complaint for the same cause of action, the petitioner has been shown only as a witness and hence, there is no need to register a separate case and since already the FIR was registered for the offences under Sections 406, 420, 120-B and 34 IPC, this petition is dismissed. However, the petitioner is directed to cooperate for the investigation before the respondents-Police. Since the case is pending from 2023 and also considering the nature of the offences, the respondents-Police are directed to file charge-sheet within a period of six months from the date of receipt of a copy of this order. 31.01.2025 cs 2 / 4
