Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorari, calling for the records relating to the order dated 20.06.2006 made in Claim Petition No.496 of 1997 on the file of the Second Additional Labour Court, Chennai and quash the said order.

For Petitioners : Mr.D.Suriya Narayanan, Additional Government Pleader.

For Respondents-1&2 : Dismissed vide Court Order dated 25.11.2009.

For Respondent-3 : Labour Court.

O R D E R

This Court on 25.11.2009 passed an order, which reads as under:- "It is brought to the attention of the advocate that the following matters were listed before the Deputy Registrar (A.S.) for default in payment of batta so as to effect service on the respondents.

(2) Since the batta has not been paid till today in spite of sufficient opportunity given, the matters are listed today before this Court as a last chance.

(3) Advocate is directed to pay batta on or before 09.12.2009 and proof of compliance to be filed immediately. If batta is filed as directed issue notice immediately.

Failing payment of batta as directed, the petition shall stand dismissed automatically as against the concerned respondent without reference to the Court."

2. The matter is listed for hearing today i.e., on 23.10.2019. A perusal of the case bundle reveals that the defects notified by the Registry has not been rectified within the time stipulated by this Court. Thus, the writ petition stands dismissed. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is also dismissed.
