O R D E R

This Writ Petition has been filed challenging the impugned Form-VII registered in favour of the third respondent vide proceedings dated 20.03.2023 by the second respondent.

2. The petitioner is a registered Association and there has been dispute with regard to election for the post of President and State General Secretary. In the year 2017, a dispute arouse between the petitioner Association and the third respondent as the third respondent has proclaimed himself as the State General Secretary of the Association contrary to the bye-law and submitted Form-VII under Sub-Rule (2) of Rule 17 of the Tamil Nadu Societies

Registration Rule, 1978 to the second respondent, for which, objections were raised on behalf of the petitioner Association. Finally, an ex-parte order was passed by the second respondent, by proceedings dated 09.07.2018 and thereafter, an enquiry was conducted and ultimately, the first respondent directed the parties to approach the civil Court vide proceedings dated 03.02.2020. Pursuant to the same, a suit was filed before this Court in C.S.No.889 of 2018 by the third respondent which was later re-numbered as O.S.No.2206 of 2019 on the file of learned XIXth Additional City Civil Court, Chennai. In the said suit, trial was over and arguments are to be advanced. While so, the second respondent registered Form-VII in favour of the third respondent by proceedings dated 20.03.2023, which is impugned in the present writ petition. Challenging the same, the present writ petition has been filed.

3. The learned counsel appearing for the petitioner narrated the aforesaid facts and submitted that the suit in O.S.No.2206 of 2019 has been decreed in favour of the third respondent, against which, an appeal has been filed by the petitioner Association in A.S.No.949 of 2024 before this Court

which is pending. Hence, this Court may grant liberty to the petitioner to canvass all the points raised in this writ petition in the pending appeal.

Since the disputed questions of facts are involved and that an appeal is pending before this Court concerning the same issue, this Court cannot go into the merits of the contentions raised by the writ petitioner as well as the objections of the third respondent in the present writ petition. Hence, this Writ Petition is disposed of with liberty to the petitioner to raise all the contentions raised in the present writ petition in the pending appeal. There shall be no order as to costs. Connected miscellaneous petitions are closed.
