This writ petition has been filed seeking issuance of a writ of mandamus directing the second respondent to deal with the representation made by the petitioner on 11.02.2021 wherein the petitioner is seeking for refund of the stamp duty paid at the time of presentation of the sale deed in the year 2019, which was refused to be registered through a refusal check slip dated 06.08.2020.

2. Heard Mr.J.Chelladurai Caldwell, learned counsel for petitioner and Mr.B.Vijay, learned Additional Government Pleader appearing for respondents.

In the considered view of this Court, the petitioner had paid the stamp duty at the time of presenting the sale deed for registration and for some reason, the same was refused to be registered by issuing a refusal check slip dated 06.08.2020. Thereafter, the petitioner did not represent the document and insist for registration. Therefore, the petitioner is seeking for refund of the stamp duty paid. The petitioner has been making representations from 11.02.2021 onwards seeking for refund of the stamp duty and there was exchange of communication 2/4

between the parties. Considering the peculiar facts and circumstances of the case, this Court is inclined to direct the second respondent to deal with the representation made by the petitioner dated 01.08.2022 and refund the stamp duty paid by the petitioner within a period of four (4) weeks from the date of receipt of a copy of this order. This writ petition is disposed of with the above direction. No costs.
