ORDER

The petitioner has filed this writ petition seeking for issuance of a writ of mandamus to direct the third respondent / the Tahsildar, Chengalpattu, to dispose of his pending representation dated 13.06.2012 requesting to issue patta in his name.

2. The claim of the petitioner is that his father/M.Palani had purchased a plot on 14.07.1983 from M.S.Madasamy, M.Vijayakumar, M.Selvaraj and it was registered on the file of the Sub-Registrar Office, Tambaram. Whileso, on 25.04.2008, his father executed a settlement deed dated 25.04.2008 in his favour and since then, he has been in peaceful possession and enjoyment of the said property. Therefore, he had applied for issuance of patta in his favour on 13.06.2012 to the third respondent, but, till date, he has not been issued with any patta by the third respondent.

3. Learned Government Advocate appearing for the respondents submitted that if the petitioner really had purchased the land in question from M.S.Madasamy, M.Vijayakumar, M.Selvaraj, vide sale deed dated 14.07.1983, 2/4

registered on the file of the Sub-Registrar Office, Tambaram, he has to produce the patta of his previous vendor and only thereafter, the request of the petitioner seeking patta in his name would be considered.

In view of the above, the petitioner is directed to produce a copy of the patta belonging to his previous vendor to the third respondent along with a copy of this order and sale deed, and on production of the same, the third respondent is directed pass orders on his pending representation dated 13.06.2012 in accordance with law, within a period of four weeks thereafter. With this direction, the writ petition stands disposed of. No Costs. 27.09.2019 rkm 3/4
