Prayer: This Civil Miscellaneous Second Appeal has been filed under Oder 41 Rule 1 of CPC read with under section 100 of the Code of Civil Procedure against the judgment and decree of the Subordinate Judge, Hosur dated 14.06.2011 made in C.M.A.No.5 of 2008 confirming the Order of the District Munsif, Hosur, dated 18.11.2008 made in REA.2 of 2003.

J U D G M E N T

When the matter came up for hearing on 18.03.2022, the learned counsel for the appellant submitted that he had sent a letter to his client seeking instructions. Since no instructions was received from his client, the appeal was adjourned to 25.03.2022. Again on 25.03.2022, at the request of the appellant, the matter was adjourned to 01.04.2022.

2. When the matter is taken up today, the learned counsel for the appellant would state that even though he had sent a registered letter to the appellant seeking instructions in this matter, he has not received any instructions from his client. 3. In view of the above facts and circumstances, this Civil Miscellaneous Second Appeal is dismissed for non prosecution. Consequently connected miscellaneous petition is closed. No costs.
