PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus to call for the records pertaining to the impugned notice dated 26.11.2024 issued by the 3rd respondent, quash the same and consequently direct the 3rd respondent to receive the fair rent of Rs.3,250/- from 01.7.2024 onwards.

ORDER

The writ petition has been filed challenging the notice dated 26.11.2024 issued by the third respondent and for a consequential direction to the third respondent to receive the fair rent from the petitioner from 01.7.2024 onwards.

2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondents.

3. The connected writ petitions in W.P.No.12149 of 2025 etc. cases were disposed of on 04.4.2025 wherein the relevant portion reads as hereunder :

"6. In view thereof, these Writ Petitions are disposed of on the following terms;

(i) The petitioners have agreed before this Court that they will agitate in respect of the quantum of rent that is fixed by the committee and the same shall be the rent that is fixed for the month of May- 2024 onwards;

(ii) The rent that is paid on the existing rates 2/5

until the month of April 2024 shall be accepted as full quit and the rent shall be calculated on the new rates from the month of May 2024;

(iii) Accordingly the amounts paid by the petitioner shall be reconciled and if any amount further to be paid by the petitioner the same shall be intimated in writing to the petitioners within one week from the date of receipt of the copy of the web copy of the order, without waiting for the certified copy of the order and the petitioners shall clear the arrears within a period of 8 weeks there from;

(iv) The petitioners shall also continue to pay the revised rent without any default as per the due dates and then the authority shall also take care to periodically revise the rent without waste of time.

(v) In the event of default of payment it is always open to the authorities to take further action in the manner known to law."

4. In the light of the above, this writ petition is also disposed of in terms of the said order dated 04.4.2025 in W.P.No.12149 of 2025 etc. cases. No costs. Consequently, the connected WMP is closed. 13.6.2025 3/5
