This petition has been filed to fix an early date for the final hearing of the Habeas Corpus Petition in H.C.P.No.1582 of 2016.
2. This Court, by an order, dated 24.10.2016, had directed the Resident Medical Officer, Government Hospital, Royapettah, Chennai, to file a medical report in respect of the detenu and one of the doctors, who had been treating the detenu, was also directed to be present before this Court.
3. In view of the above order, Dr.K.V. Raja Lakshmi, M.D., Professor and Department of Medicine, Government Royapettah Hospital, Kilpauk Medical College, Chennai, is present along with the medical report.
4. Heard the learned counsel appearing on behalf of the petitioner, as well as the learned Additional Public Prosecutor, appearing on behalf of the respondents. We have also perused the medical report, dated 26.10.2016.
5. A perusal of the Medical Report reveals that there is no urgency for any surgical treatment to the detenu, at this stage, and he needs only medication at this point of time.
6. On enquiry, the said doctor also submitted before us that the patient had been discharged and his health condition does not warrant any surgical treatment, but he needs only medication, at this point of time.
7. In such circumstances, this Court does not find any cause or reason to allow the petition to fix an early date for the final hearing of the Habeas Corpus Petition. However, the petitioner is at liberty to file a petition afresh, if any need arises for the specialised treatment to the detenu, at a later stage.
