Today when the matter is taken up for hearing, learned counsel for the plaintiff appeared before this Court through Video conferencing.

2. Learned counsel for the plaintiff submitted that in respect to A.No.1040 of 2021, as per the direction of this Court, notice has been sent to the proposed defendants/respondents no.2 to 5 and their names has also been printed in the cause list. The said submission is recorded.

3. Hence, in view of the fact that after receiving the notice, the respondents have not appeared before this Court. Hence, R2 to R5 in A.No.1040 of 2021 are set ex parte and accordingly, this application is allowed.

4. Registry is directed to post the suit on 21.04.2021 to carry out the amendments and to file the amended copy of the plaint. 31.03.2021 msv
