Writ petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Certiorarified Mandamus, to call for the records of the first

respondent dated 21.01.2008/08.02.2008 in order No.MMTC/P/YK/GOLD 2004 confirming the order of the second respondent dated 28.05.2007 and the order of the third respondent dated 06.03.2006 and 01.08.2006 and quash all the above as illegal and direct the respondents to pay the benefits, with held/denied to the petitioner including promotion and monetary benefits within a stipulated time.

The relief sought for in this writ petition is to call for the records of the first respondent dated 21.01.2008/08.02.2008 in order No.MMTC/P/YK/GOLD 2004 confirming the order of the second respondent dated 28.05.2007 and the order of the third respondent dated 06.03.2006 and 01.08.2006 and quash all the above as illegal and direct the respondents to pay the benefits, with held/denied to the petitioner including promotion and monetary benefits.

2. The learned counsel for the petitioner would submit that after the case was listed for final hearing before this Court, he has taken steps to get instruction from the petitioner. However, he has been unable to get instruction from the petitioner.

3. The learned counsel for the petitioner further submitted that the letter sent to the petitioner was returned. Hence, the writ petition is dismissed with liberty to the petitioner to file a fresh petition. No costs.
