ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 4(1)(a) and 4(1-A) of the Tamil Nadu Prohibition Act, in Crime No.184 of 2017 on the file of the respondent police and hence, prays for anticipatory bail.

2.The learned counsel for the petitioner submits that the coaccused in this case has already been released on bail and therefore, he may be granted anticipatory bail.

3. The learned Government Advocate (Crl. Side) submits that the petitioner was in possession of 10 bottles Brandy of 180 ml each and that the petitioner is having one previous case, however, he concedes that the petitioner has been released on bail in that case.

4. Heard both sides.

5. Considering the fact that the co-accused has already been released on bail, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions.

6. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned District Munsiff cum Judicial Magistrate, Thirukkalikundram, Kancheepuram District and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only), with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police, once in a week i.e., on every Monday at 10.00 a.m. for a period of two months and thereafter, as and when required for interrogation. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

7. The petitioner shall appear before the concerned Judl. Magistrate within a period of three weeks from the date on which the order copy is made ready, failing which, the petition for anticipatory bail stands dismissed.
