The above application is filed to substitute the Arbitrator in the place of the earlier arbitrator.

2. Considering the fact that this Court by order dated 05.02.2020 appointed has Arbitrator who was a retired Judge of this Court and since the said Arbitrator has expressed his inability to continue as an Arbitrator in view of his being appointed as the Chairman of the Human Rights Commission, the applicant has come forward with the present application.

3. Considering the fact that the present application is only a consequence of the earlier Arbitrator expressing his inability to arbitrate the matter this Court is proceeding to allow this application. 1/3

4. In these circumstances I hereby appoint Hon'ble Ms. Justice R. Mala, (Retd.) as the Arbitrator.

5. In the result, the petition is ordered and I appoint Hon'ble Ms.. Justice R. Mala, No.26, Balaji Garden, Aanaikuppam, Anna Nagar, Cuddalore- 607 001, as Arbitrator to arbitrate the dispute between the parties. The venue and the remuneration shall be fixed by the Arbitrator herself. The procedure shall be formulated by her in consultation with the parties. No costs.
