This petition has been preferred by the petitioner before this Court seeking a direction to the second respondent to renew his passport No. M 4345965 with usual validity period of ten years pending C.C.No.9825 of 2005 on the file of the learned Additional Chief Metropolitan Magistrate, Egmore, 2.Heard Mr.B.Natarajan, learned counsel appearing for the petitioner as well as Mr.K.Srinivasan, learned Special Public Prosecutor for CBI Cases for the first respondent 3.The learned counsel for the petitioner would submit that petitioner is a Chartered Accountant and he is travelling abroad frequently for his business. He further submitted that he has no bad antecedents and seeks for renewal of passport with usual validity of ten years. 4.The learned Special Public Prosecutor would submit that as per the notification issued by the Government of India, Ministry of External Affairs, dated 25.08.1993, if any criminal case is pending, the passport can further be renewed and the same shall be issued for a specified period.

5.Considering the submissions made on either side and also considering the facts and circumstances of the case, the second respondent/Regional Passport officer is directed to renew the passport of the petitioner for a period of two years considering the other conditions required.

6.With the above direction, the Criminal Original Petition is disposed of.
