Today, when the matter was taken up for hearing, the learned Additional Government Pleader appearing for the respondents 1 to 3 submitted that during the pendency of this writ petition, based on the representation given by the fourth respondent, the third respondent issued summon to the petitioner for enquiry and conducted the enquiry. Therefore, nothing survives in this writ petition for further adjudication. He has also filed a counter affidavit of the third respondent to that effect.

2. The submission so made by the learned Additional Government Pleader appearing for the respondents 1 to 3 has been fairly conceded by the learned counsel for the petitioner.

3. Recording the above, this writ petition is dismissed as having become infructuous. No costs. Consequently, connected miscellaneous petition is closed.
