The Contempt Petition has been filed to punish the respondent for willful disobedience of the order of this Court in W.P.No.26636 of 2023 dated 13.09.2023.

2.When the matter was taken up for hearing, the learned Additional Public Prosecutor filed an affidavit of the Inspector of Police, Perundurai Police Station, Erode District. The relevant portions are extracted hereunder:

"9.It is respectfully submitted that based on the above order on 25.04.2024, I have sent requisition letter to Tahsildar, Perundurai, to verify the genuinity of the land R.S.No.711/1 to R.S.No.711/7, R.S.No.705/1 to 705/7 and also survey the land individually and also sent a report within one week.

10.It is submitted that during the course of enquiry, the Tahsildar, Perundurai sent a letter to the Inspector of Police vide Na.Ka.No.2253/2024/A4 dated 14.05.2024, states that the Revenue Divisional Officer, Erode sent a letter vide Na.Ka.No.0951/2022/A2 dated 20.01.2023 to the Thasildhar, Perundurai to conduct the enquiry and based on that, the Thashildar conducted enquiry between both the parties and after enquiry, opined that the above said petition is purely "Civil in Nature" and further directed to approach the concerned II Additional District and Sessions Judge, Erode vide O.S.No.223/2022 filed by the counter petitioner and sent the report of the same to the Inspector of Police, Perundurai Police Station on 14.05.2024.

11.It is respectfully submitted that on the Tahsildar report received by me on 14.05.2024. Based on the finding of the 2/5

Executive Magistrate, Perundurai. On 23.05.2024, I have issued summon to both the parties and the same was duly acknowledged by them on the same day. I have closed the enquiry by proceedings dated 27.05.2024, and also informing both the parties to approach the civil court and seek appropriate remedy and served in person on 27.05.2024 at the respondent police station.

12.It is respectfully submitted that after completion of investigation, I have filed a charge sheet in Cr.No.570/2023 u/s. 147, 447, 294(b), 427, 506(i) IPC against the accused Tr.Arumugam, Subramani, Sivakumar, Mathavan, Sangeetha, Sowndary before the Judicial Magistrate, Perundurai and on 26.05.2024 vide e-filing L.T.No.202400498 and the same was yet to be taken on file."
