Ganesh Ram Patel And 3 Others v. K.Swamnidos Augustine And 6 Others

A.No.2137 of 2022 in C.S.No.283 of 2021 Krishnan Ramasamy, J., This Application is filed to withdraw O.S.No.4443 of 2019 pending on the file of the XVI Additional City Civil Court, Chennai and to transfer the same to the file of this Court and jointly be tried along with C.S.No.283 of 2021.

2. Learned counsel for the applicants would submit that the schedule properties in the present suit in C.S.No.283 of 2021 and O.S.No.4443 of 2019 are one and the same and therefore, both the suit may be heard and tried together.

3. Learned counsel appearing for the respondents would submit that they have no objection for the same.

4. Considering the submission made by the respective counsel that the schedule properties in both the above mentioned suits are one and the same, this Court is of the view that it is appropriate to take both the suits together.
